Drug Charge Defense in Middle Tennessee

Tennessee drug charges range from simple possession or casual exchange, generally a Class A misdemeanor (Tenn. Code Ann. § 39-17-418), to felony charges for manufacturing, delivering or selling, or possessing with intent to do so (Tenn. Code Ann. § 39-17-417). The charge depends on the substance, the amount, your record and what police say they found.

What we look at

• Whether the search of your car, home or person was lawful.

• Whether the State can prove the drugs were yours.

• How the substance was tested and identified.

• Whether you may qualify for pretrial diversion (Tenn. Code Ann. § 40-15-105) or judicial diversion (Tenn. Code Ann. § 40-35-313). Completing diversion leads to dismissal, and the record can then be expunged.

• Whether a recovery court fits your situation.

Recovery courts in every county we serve. Sumner County Recovery Court (plus DUI and Mental Health Courts), Wilson County Recovery Court, Robertson County Recovery Court, Williamson County DUI, Veterans and Mental Health Courts, and Davidson County's Misdemeanor Recovery Court and Residential Drug Court (DC4). Chloe Hawes serves the Recovery Courts of Sumner County.

Why Early Help Matters

What you say to police, and decisions made before the first court date, can shape the case. Talk to a lawyer before you discuss the case with anyone.

Drug cases start in General Sessions Court in the county where you were charged. Felony cases can be bound over to the grand jury and move to Criminal Court (Sumner, Davidson) or Circuit Court (Wilson, Robertson, Williamson). We stay with you through settlement or trial.

Charged with DUI instead? See our DUI defense page. Case already dismissed or completed diversion? Read about expungement. For other charges, see criminal defense.
